Under Draft, Regulator Would Re-open Retail Supplier's Licensing Docket For Investigation Of ...

The Connecticut PURA issued a draft order under which PURA would reopen the licensing docket of Spark Energy, LP, "to investigate Spark’s marketing, billing, and enrollment practices, as well as compliance with notification requirements."

If the draft is later adopted as final, the new docket would be Docket No. 10-06-18RE03, Application of Spark Energy, L.P. for an Electric Supply License - Investigation into Marketing, Billing, and Enrollment Practices and Notification Compliance.

In the draft, PURA states, "The Authority has received complaints and interrogatory responses regarding Spark misinforming customers of their rates in renewal notices, stating that customers were enrolling in month-to-month contracts, regarding billing and enrollment discrepencies, and regarding marketing. Furthermore, the Authority has received responses from Spark to interrogatories in Docket No. 10-06-18, Application of Spark Energy, L.P. for an Electric Supplier License, which indicate that Spark failed to notify the Authority of corporate changes at least ten days prior to such changes taking effect as statutorily required."

PURA recently concluded a separate proceeding which investigated a specific pre-recorded telemarketing message that PURA found a non-contracted subcontractor of an agent of Spark had used, with PURA issuing a fine of $750,000 (see details here)
