FERC Affirms That Bids From ISO-NE Out-Of-Market Reliability Program Were Just And Reasonable

FERC issued an order on remand accepting an ISO New England compliance filing concerning the 2013-2014 Winter Reliability Program, and found that the bid results from the 2013-2014 Winter Reliability Program are just and reasonable.

Costs of the program were recovered via uplift to LSEs (Real-Time Load Obligation)

The Commission additionally provided the further reasoning requested by the court for this finding.

FERC was addressing the issue on remand. In a series of orders issued from September through November 2013, the Commission accepted ISO New England Inc.’s (ISO-NE) 2013-2014 Winter Reliability Program. On December 22, 2015, the D.C. Circuit remanded to the Commission the question of whether the prices paid for service under the Program were just and reasonable. On August 26, 2016, the Commission directed ISO-NE to provide further information on this issue, which it subsequently provided.
