Federal Judge Declines To Grant Preliminary Injunction To Allow Nuclear Subsidy Opponents More Time

A federal judge denied a petition from Ohioans Against Corporate Bailouts for a preliminary injunction which would have provided the group with 38 additional days to collect signatures for a proposed ballot initiative to repeal HB 6, the nuclear subsidy bill

Instead, the federal court sent a series of certificated questions to the Ohio Supreme Court, finding that the issues relate to Ohio's constitution.

Ohioans Against Corporate Bailouts did not collect enough signatures within the statutory timeframe for the measure to appear on the 2020 ballot, but as previously reported, the group had argued that certain factors infringed on its federal protected rights under the 1st and 14th amendments, and had sought relief from the federal court
