The Public Utilities Commission of Ohio has ordered the FirstEnergy electric distribution companies to cease collecting amounts under the distribution modernization rider (Rider DMR) and to immediately file proposed revised tariffs setting Rider DMR to $0.00.

PUCO's order follows the Ohio Supreme Court's action earlier this week to deny a motion for reconsideration from the FirstEnergy EDCs concerning the court's prior finding that PUCO erred in approving Rider DMR (see background here)

Notably, Rider DMR is part of the EDCs' electric security plan, which also encompasses various provisions impacting default service procurement and pricing and the retail market. PUCO had previously ruled that the FirstEnergy Ohio EDCs may elect to withdraw an electric security plan in response to an adverse court ruling (such as the Court's DMR ruling which directed the Commission to amend the EDCs’ tariffs to remove Rider DMR from the Companies’ ESP)

PUCO also directed the EDCs to issue a refund to customers for any monies collected through Rider DMR for services rendered after July 2, 2019. The refund is to be made in the form of a credit to customer bills, which will be accompanied with a bill insert to explain the refund.
