In PPL Transmission Rate Complaint, Amtrak Asks FERC To Order Refunds From Retail Supplier

Amtrak has filed another transmission rate complaint against PPL Electric at FERC.

In the complaint, Amtrak alleges, "PPL has not sought or received authorization from FERC for its method of calculating transmission obligations for customers taking electric supply from EGSs [retail suppliers] within its territory. Nor has PPL provided this information in its PA PUC-approved tariffs. PPL’s failure to secure FERC authorization of such alterations is in violation of FERC’s authority over the rates, terms, and conditions of unbundled transmission service."

Amtrak's retail supplier for load at issue in the complaint is Constellation NewEnergy, Inc. (CNE) Amtrak sought from FERC an order directing, "PPL, PJM, and CNE to refund all amounts collected from Amtrak for PPL-related transmission service from December 2, 2002 or such other refund effective date as determined by the Commission, with interest from that refund effective date."
