FERC Dismisses Petition For Declaratory Order On Energy Efficiency Measurement In Capacity Market

FERC dismissed as premature a petition from Advanced Energy Economy and Sustainable FERC Project related to potential future changes to the manner in which ISO New England Inc. (ISO-NE) measures demand reduction values of energy efficiency resources for purposes of participating in its Forward Capacity Market (FCM).

Petitioners had stated that ISO-NE staff indicated that ISO-NE intended to change the manner in which it measures the demand reduction value of energy efficiency resources for purposes of participation in the FCM (i.e., from adjusted gross reduction to energy consumption from the baseline federal standards to net energy savings).

In an answer, ISO-NE stated that, if it decides to propose any such changes to its M&V standards, it will not implement them without first vetting the changes through the normal stakeholder process and will make any necessary filing with the Commission if those changes require modifications to the Tariff

ISO-NE further clarified that, if it determines that imposing a gross-to-net savings methodology for determining the capacity value of energy efficiency resources is warranted, it only would implement such a methodology after vetting the proposal through the ISO-NE stakeholder process and making a filing under FPA section 205 to revise its Tariff.

As such, FERC said that, "We find that the harm alleged in the Petition is speculative in light of ISO-NE’s clarification that it has not made any proposal, nor does it currently have any plans, to change its M&V standards. Furthermore ... because ISO-NE has not proposed a change to its M&V standards, there is no concrete proposal for the Commission to evaluate to determine whether a Tariff filing is required. As such, there is no controversy or uncertainty necessitating a declaratory finding at this time."
