FERC to Appeal Demand Response Jurisdiction, Compensation Ruling

FERC is set to appeal to the Supreme Court an appeals court order which held that FERC lacks jurisdiction over demand response in the energy market, vacating FERC's compensation structure for energy market demand response (Order 745)

Specifically, the U.S. Solicitor General has authorized the filing of a petition for a writ of certiorari seeking review of the appeals court's order, and asked that the deadline for such writ be extended to January 15 from December 16
