N.J. Bill Would Eliminate Voice, Electronic Authorization for Contracts, Require Written Signature

A bill (A3851, S2468) has been introduced into the New Jersey legislature which would require all third party energy supply contracts to be executed via written contract.

A3851 would strike from statute the current ability for suppliers to contract via voice recording, TPV, and electronic signature, and instead require that contracts have the customer's signature, "in written form only."

The bill would also require a standard one page summary/disclosure statement for contracts, which notably would require a statement regarding, "how weather fluctuations may affect the price of variable rate contracts."

Other retail energy legislation proposed in New Jersey includes:

• Bill A3850/S2467, which would require the BPU to establish procedures to ensure that within 30 calendar days of a customer’s request, a customer shall be permitted to switch electric generation service from an electric power supplier to a basic generation service provider, or switch gas supply service from a gas supplier to a basic gas supply service.

• Bill A3849/S2466, which would require the BPU to provide on its website pricing information for electric generation services provided by an electric power supplier and gas supply service provided by a gas supplier, and other information, as determined by the Board, including, but not limited to, other services provided by electric power and gas suppliers
