FirstEnergy Solutions "Polar Vortex" Surcharge Now Showing Up In Commercial Customer Bills

June 11,2014

The Cleveland Plain Dealer reports that FirstEnergy Solutions' pass-through of ancillaries, approximated at 1-3% of a business customer's annual generation costs, has begun showing up on C&I customer bills.

Of note is what the Plain Dealer described as a "threatening letter" FES has allegedly sent to one customer concerning customer dispute and non-payment of the surcharge

"'[The customer's] ability to dispute the RTO Expense Surcharge in good faith is questionable. FES reserves any and all available remedies if [the customer] fails to pay the invoice in full in a timely manner,' concluded one letter from Ulmer & Berne, LLP, a Cleveland firm FES has retained to deal with the charges, in a letter to an FES customer company. That company has asked to remain anonymous," the Cleveland Plain Dealer reports.
