Texas State Rep. Files Bill To Prohibit Higher, Special TDU Charges For Solar Customers

Texas state Rep. Joe Pickett, D-El Paso, has filed a bill (HB 199) during the special session to prohibit utilities from imposing a charge solely on distributed generation owners or " significantly" higher charges for such DG owners

The bill would provide that, "An electric utility may not impose on residential customers who are distributed solar or wind renewable generation owners: (1) a rate or charge that applies only to those customers; or (2) a rate or charge that is significantly higher than a similar charge imposed on residential customers who are not distributed solar or wind renewable generation owners."

The bill does not define "significantly" higher.

Pickett tells the El Paso Times that the bill was meant to spur discussion and set the issue for the next regular session

While prompted by solar issues at El Paso, the bill has broader implications into Texas' retail choice areas, since, as was exclusively first reported by EnergyChoiceMatters.com, Oncor has proposed a minimum charge for solar customers
