Update on Litigation Between NRG, Denton Municipal Electric Over Wholesale Contract

November 10,2015

The Denton Record-Chronicle published an update concerning litigation concerning a contractual dispute between Denton Municipal Electric and NRG Power Marketing over a wholesale supply contract

Denton Municipal Electric alleges that it was entitled to certain credits from the ERCOT market; NRG says the contract does not call for payments.

An NRG spokesperson provided the following statement to RetailEnergyX.com: "NRG provided Denton with full requirements service for four years. As per the contract, NRG absorbed all the risks, charges and credits and in return, provided Denton a fixed, risk-free price for power. I would point out that, as Denton’s counsel freely admitted, there is nothing in the contract that specifically addresses NRG remitting CARD [CRR Auction Revenue Distribution] revenues to Denton."
