Texas Bill Would Require No-Fee Smart Meter Opt-Out, Make TDUs Civilly Liable for AMS Privacy Breach

A bill (SB 1044) has been filed with the Texas legislature which would provide customers with a no-fee opt-out from advance meters, and also make TDUs civilly liable for data breaches associated with smart maters.
SB 1044 would require TDUs, including TDUs with already deployed smart meters, to provide customers, at no charge, the ability to decline a smart meter or have the smart meter replaced with a traditional meter.
A customer electing traditional metering service would not be charged the nonbypassable AMS surcharge, and would not be charged for removing the smart meter or for costs associated with traditional metering services
A customer who chooses not to use an advanced meter and the TDU may agree that the customer will self-report meter data by telephone or electronic mail in place of traditional metering services.
The bill also provides that a TDU that has deployed advanced meters that transmit data using wireless technology is, "civilly liable to a customer for damages for invasion of the customer's personal privacy, including any economic damages caused by the loss, misuse, or theft of information about the customer that was acquired by use of an advanced meter."
