As first reported by EnergyChoiceMatters.com, Enforcement Staff alleged that Hiko's disclosure statement for the affected customers informed customers that they would receive a guaranteed rate for "the first six monthly billing cycles" (the introductory period) that would be "1-7% less" than the local EDC's Price To Compare, but that Hiko billed a rate which exceeded this guaranteed rate.
According to the Morning-Call, Hiko said it has reimbursed a "substantial" number of customers, and also argued that the PUC lacks authority to order refunds (an argument made by several suppliers recently, and one which we are eagerly awaiting to arrive at the Commissioners for precedent-setting disposition).
