PUCT Chair Cites Separation Of Oncor From REP Affiliate In Public Interest Finding For Transaction

In a memo discussing the Commission's consideration of the application of Hunt Consolidated and affiliates to acquire Oncor, Texas Public Utility Commission Chairman Donna Nelson cited the separation of Oncor from competitive affiliates as among the reasons the transaction, subject to various commitments and conditions, may be found to be in the public interest.
"This plan for bankruptcy resolution provides a unique benefit in that it would remove affiliation with generation or retail electric provider affiliates. In other words, for the first time since restructuring, Oncor would be a stand-alone TDU, unaffiliated with generation or retail electric providers. As former Chairman Pat Wood pointed out, this was a goal long-sought by our Commission since restructuring the electric market, and I find value in that result," Nelson wrote
Nelson's memo also lists various other factors that lead to a conclusion that the transaction would be in the public interest, and also addresses the issue of tax expense treatment
