Another Lawsuit Filed Against Retail Supplier Concerning Do Not Call Law

Frontier Utilities LLC is the latest retail supplier to find itself subject to a lawsuit concerning alleged violations of Do Not Call provisions
The suit, filed in the United States District Court For Eastern District Of New York and which seeks class action status, alleges that, "in Frontier’s zeal to attract new customers, it repeatedly made unsolicited promotional telephone calls to Plaintiff and the other members of a putative Class of consumers (defined below)—whose telephones numbers appeared on the National Do Not Call Registry—in violation of the Telephone Consumer Protection Act, 47 U.S.C. § 227"
"Frontier also knowingly made (and continues to make) these telemarketing calls after consumers requested that the calls cease," the suit alleges.
Though not as popular as class action suits regarding retail supplier pricing, a smaller wave of class action suits concerning Do Not Call laws have been filed against various retail suppliers over the past 6 months.
Frontier Utilities provided RetailEnergyX.com with the following statement:
"Frontier Utilities is aware of the allegations made against it in the New York District Court and denies any wrongdoing. Frontier Utilities reserves further comment as it does not comment on active litigation."
