New York PSC Approves Tariff With Further NiMo Capacity Release Changes Already Reflected In GTOP

The New York PSC gave formal approval to further capacity release changes at Niagara Mohawk which have already been included in the Company’s Gas Transportation Operating Manual and were previously the subject of a collaborative with ESCOs

The approved tariff filing formalized the following: (1) add a description of the minimum delivery requirements for the customers under daily and monthly balancing services, which includes penalty charges for non-compliance; (2) include references to other pipelines in the Company’s portfolio that were inadvertently omitted; (3) modify the definition "Gas Supply Service" to "General Storage Service" to read "DTI’s rate schedule governing the storage of gas;" (4) clarify marketer responsibilities, specifically that "Marketers must accept all capacity releases or assignments;" (5) modify and remove language that is housekeeping in nature; (6) clarify language regarding storage capacity release; and, (7) amend its Statement of Demand Transfer Recovery Rate (DTR) applicable to SC No. 11 to remove the reference solely to DTI so as to be inclusive of the other pipelines supplying gas to the Company.

The PSC noted that the inclusion of pipelines in the Company’s portfolio under the filing accurately reflects the "slice of the system" approach that constitutes a part of the Capacity Release Program which was recently implemented (see story here)

The PSC also said that the language that, "Marketers must accept all capacity releases or assignments," clarifies, "an important responsibility of the marketers."
