Ownership of Retail Provider Disputed at Texas PUC

The ownership of a Texas retail provider is being disputed at the Public Utility Commission of Texas, after two individuals averring to have current ownership interests in the REP alleged that a REP certificate amendment filing purporting to change the REP's ownership was not authorized to be filed.
On October 8 a REP certificate amendment was filed for Jade Energy, LLC d/b/a Bose Power & Electric. While the amendment included some public changes (including a new officer, as reported by EnergyChoiceMatters.com), the amendment included changes filed under seal, including confidential materials related to a "Change in Ownership/Control" and "Corporate Restructuring."
In response to the amendment filing, a letter on behalf of Drs. Subhash and Sarojini Bose was filed with the PUCT yesterday.
The letter from counsel to Drs. Subhash and Sarojini Bose stated, "It has recently come to our attention that a company in which they own and have invested 100% of the capital has had a member submit the above referenced filing attempting to change ownership without either their knowledge or permission."
"We are respectfully asking that we be allowed to intervene in the above referenced docket number and request that the filing be withdrawn until the Bose family and the PUCT fully and finally understand why such a filing was submitted under the circumstances," the letter stated.
