FERC Staff Alleges PSEG ER&T Violated Tariff By Allegedly Submitting Incorrect Cost-Based Bids

FERC posted a Staff Notice of Alleged Violations stating that, "in a nonpublic investigation pursuant to 18 C.F.R. Part 1b, the staff of the Office of Enforcement of the Federal Energy Regulatory Commission has preliminarily determined that PSEG Energy Resources & Trade, LLC (PSEG ER&T) violated §§ 1.2 and 6.4.2(a)(ii) of Schedule 1 of the PJM Operating Agreement and Attachment K-Appendix of the PJM Open Access Transmission Tariff by submitting incorrect cost-based bids into the PJM energy market beginning as early as 2005 and continuing through March 2014."

In FERC's Staff Notice of Alleged Violations, FERC stated, "Staff also has preliminarily determined that PSEG ER&T violated Commission regulation, 18 C.F.R. § 35.41(b), by making false and misleading statements to PJM regarding the costs associated with certain units for which PSEG ER&T submitted cost-based bids into the PJM energy market."
