NY PSC Affirms Utilities May Own Distributed Generation

The New York PSC issued a rehearing order affirming the circumstances under which the distribution utilities may own distributed energy resources
As previously reported, the PSC in a REV order allowed utilities to own DER in certain situations, including a market failure that results in no DER options for low-income customers
IPPs sought clarification of this prior order based on the use of the term "invest" in one part of the order. IPPs argued that the PSC, by stating utilities could "invest" in DER in circumstances of a low-income market failure, indicated that utilities were to provide access to financing and other support that would enable low-income customers to own DER themselves, rather than having the utilities own the DER.
The PSC rejected this interpretation, and said that its order was clear that utility-ownership of DER is appropriate under the circumstances outlined in its prior order, including a market failure for low-income customers
