Update: Senate Passes Bill To Terminate Authority For General Land Office To Sell Retail Power

The Texas Senate recently passed a bill SB 736 that would terminate the statutory grant of authority that currently allows the Texas General Land Office (GLO) to sell power to public retail customers
As originally written, the bills would have stricken from current Section 35.102 of the Utilities Code the authority for the GLO to sell or convey "power" directly to a public retail customer, effective September 1, 2017. The GLO would retain the authority to sell natural gas to public retail customers under the bills
As passed by the Senate, the GLO Commissioner's authority to sell or convey power would expire September 1, 2022
Chron.com reports that the House Land and Resource Management Committee, which already left HB 1685 pending previously, was expected to address the bill at a hearing yesterday; however, it did not appear the bill was ultimately taken up during such hearing.
Currently, the GLO offers retail electricity supply to various public entities under the State Power Program (SPP), with Cavallo Energy Texas LLC (Champion Energy/Calpine) acting as the supplier. Public retail customers eligible for the program include schools, cities and counties, state agencies, and other public facilities.
