Generators File Suit Against Illinois Nuclear Subsidies

Various generators have filed suit against Illinois' nuclear zero emissions credit program which provides subsidies to nuclear power plants

A second suit brought by certain end users was also filed

Illinois' ZEC program is notable in that it does not place a ZEC obligation on retail suppliers (as New York does), instead placing the compliance obligation on utilities for all applicable distribution customers

However, the ZEC legislation could negatively impact the retail market as it requires the ICC to consider placing a new tax (assessment) on retail suppliers (see story here)
