Retail Supplier To Pay $1.1 Million In Class Action Telemarketing Settlement

Alpha Gas and Electric, LLC recently entered into a settlement under which it would pay $1.1 million under a class action settlement to resolve allegations from an individual that the supplier violated the federal Telephone Consumer Protection Act, 47 U.S.C. § 227(b), by allegedly sending unsolicited telemarketing calls to the cell phones of consumers via an Automatic Telephone Dialing System (ATDS).
Only class members who received telemarketing calls on their cell phones in violation of the TCPA are eligible to receive cash compensation.
The complaint had alleged that Alpha allegedly made or caused to be made 450,000 telemarketing calls to 250,000 unique cell telephone numbers.
A federal court has granted preliminary approval of the settlement (Case No. 7:15-CV-05299-KMK)
