In Memo, Texas PUC’s Anderson Reiterates Concerns With Oncor New Competitive Affiliates Under M&A

Texas Public Utility Commissioner Kenneth Anderson filed a memo concerning a proposed acquisition of Energy Future Holdings, and Oncor, by NextEra Energy

In light of certain discussions which occurred at a Delaware bankruptcy court hearing, Anderson wrote that he decided not to file a detailed memorandum that he originally intended and had discussed at the prior open meeting, and upon the advice of counsel, will not comment in any substantive way upon the EFH-NextEra merger agreement

However, Anderson did write that, "I want to state clearly on the record that I share my colleagues concern about persons controlling Oncor, also owning or controlling substantial Texas competitive affiliates within the Electric Reliability Council of Texas, Inc. ('ERCOT'). This will be among the central issues to be resolved in the expected change of control proceeding."
