Texas Staff Propose Allowing Various Entities To Sign Distributed Generation IAs

Staff of the Public Utility Commission of Texas have filed a draft proposal for publication (PFP) to amend the Pro-Forma Interconnection Agreement in 16 TAC ยง 25.211, Interconnection of On-Site Distributed Generation (DG), to address the issue of which type of entity can be a party to a DG interconnection agreement (IA) along with the utility.
The PFP is similar to the first option of the two previously issued strawmen, and would allow the end-use customer to choose any of the following types of entities to be the party to the IA with the utility: the end-use customer, the owner of the DG facility, an owner of rights to energy produced from the DG facility, or the owner of the premises at which the DG facility is located.
The PFP would require that, if the end-use customer chooses another entity to be the non-utility party to the IA, the end-use customer would still have to sign the IA to acknowledge that the end-use customer authorizes the particular non-utility entity identified in the IA to be the non-utility party to the IA.
