Pa. PUC Confirms Noble Americas Energy Solutions Was Always In Compliance With Security Requirement

The Pennsylvania PUC in a secretarial letter issued on November 24 confirmed that Noble Americas Energy Solutions LLC was always in compliance with applicable security requirements and should not have been listed in a November 19 tentative order which addressed companies not in compliance.

The PUC's November 24 secretarial letter states, "On November 19, 2015, the Pennsylvania Public Utility Commission (Commission) entered a Tentative Order at Docket No. M-2015-2490383, listing various Electric Generation Suppliers (EGSs) that had failed to provide documentation evidencing compliance that a bond or other approved security, in an amount directed by the Commission, has been obtained in accordance with 52 Pa. Code §54.40(d). Further, the Tentative Order indicated that the required documentation had not been submitted to the Commission by November 9, 2015. Noble Americas Energy Solutions, LLC (Noble Americas) was included in the list of EGSs that had not filed the required documentation."

"Upon further review, it was determined that Noble Americas had filed documentation evidencing that it had obtained the required documentation prior to November 9, 2015. On October 28, 2015, the Commission received a Continuation Certificate and Rider to Noble Americas’ bond, and both were accepted on November 4, 2015," the PUC's secretarial letter states

"Therefore, Noble Americas is in compliance with the Commission’s regulations at §54.40(d) regarding filing proof that a bond or other approved security, in an amount approved by the Commission, had been obtained. Additionally, the Commission’s Final Order will reflect Noble Americas compliance with the dates as specified in the Tentative Order," the PUC's secretarial letter states
