Bidding Process Prompts Customer Lawsuit Against Municipal Aggregation

April 15,2014

Cincinnati.com reports that a Green Township resident has filed a lawsuit against the township over the township's opt-out aggregation.

The complainant alleges that the township trustees failed to conduct a competitive bidding process to select a supplier for a new term of the aggregation, and therefore breached their fiduciary responsibility.

Cincinnati.com reports that an attorney for the township said that the township is not required by law to seek out competitive bids for the aggregation program, and is not required to accept the lowest bid. The attorney also said that two bids were received, though one was an oral bid.
