The Pennsylvania PUC today issued two tentative orders that would, if later approved as final, revoke the licenses of several retail energy suppliers and brokers

In Docket M-2022-3030293, the PUC tentatively proposes to revoke the licenses of over 20 suppliers and brokers for alleged failure to file an annual report and/or pay an annual fee, as of May 3, 2022. As such, there is the potential an NGS has since come into compliance since that date

The NGS tentative order includes some 8 entities which take title to the natural gas (e.g. suppliers)

The PUC's tentative NGS order with a list of subject NGSs can be found here. The PUC's order is tentative and no formal finding of a violation has occurred. NGSs may challenge the tentative findings.

Separately, in Docket M-2022-3030286, the PUC tentatively proposes to revoke the licenses of 5 brokers for alleged failure to file proof of security in the format approved by the PUC. Inclusion in the tentative order does not necessarily mean that an EGS does not have the required security, but rather that the EGS has not demonstrated compliance in the specific manner required by the PUC. Additionally, the PUC's order lists the alleged non-compliance as of May 3, 2022; there is the potential that an EGS has since come into compliance since that date. Additionally, prior tentative orders have erroneously included EGSs which actually have made the required filings.

For the reasons stated above, we again caution that a company's inclusion in either of the tentative orders should not necessarily be taken as an indication of non-compliance
