Mississippi Court Dismisses Long-Winding Suit Against Entergy Over Use Of Owed Generation vs Market

A Mississippi state court has granted summary judgment and dismissed a suit brought by the state's attorney general against Entergy Mississippi which had alleged that the utility forced customers to purchase power from units owned by the utility and affiliates (under the Entergy System Agreement), rather than cheaper wholesale power from competitive suppliers in the wholesale market

The state court ruled that it lacked jurisdiction over the matter, as it arises under a FERC tariff (related to the Entergy System Agreement), over which FERC has exclusive jurisdiction
