State AGs Press FERC On States' Authority To Contract For Generation Capacity

The Attorneys General of several states have written a letter to FERC urging FERC to recognize states' authority to contract for generation capacity to meet various state policy goals
Among other things, the AGs said that FERC, "should promote market design choices that appropriately recognize the rights of states under the Federal Power Act to shape their resource mixes. It is not just and reasonable to seek high prices to maintain the competitiveness of aging, uneconomic, and higher-emitting resources by discriminating against state-supported cleaner technologies."
The letter was led by Massachusetts Attorney General Maura Healey and joined by the attorneys general of California, Connecticut, Delaware, Maryland, Michigan, North Carolina, Oregon, Pennsylvania, Rhode Island, as well as the District of Columbia.
