Bill Introduced To Eliminate Migration Rider

A bill has again been introduced in the Pennsylvania legislature to eliminate the natural gas migration rider.

The current migration requires that reconciliations of prior natural gas default service costs follow the customer if they leave for competitive supply.

During the prior legislative session, the House passed a bill (HB 1188) to eliminate the migration rider, but the bill did not pass the Senate.

For the 2015-16 session, a new bill, House Bill 57, has been introduced with identical text to HB 1188 to eliminate the migration rider.

The bill would specifically strike statuary language providing that, "The commission [PUC} shall require that customers transferring from sales to transportation service be subject to the over-or-under collection adjustment provided for in paragraph (5) [relating to natural gas costs] and shall require further that customers transferring from transportation service to sales service not be subject to the over-or-under collection adjustment for an appropriate period following either such transfer."

Instead, House Bill 57 would provide that, "If the natural gas distribution company's actual natural gas costs exceed the revenues collected under paragraph (2) by more than 10% in the previous 12-month period provided for under paragraph (5) due to customers switching from sales service to transportation service, the natural gas distribution company shall have the right to fully recover the under-collection through a nonbypassable charge. A request for authorization to impose a nonbypassable charge shall be made to the commission in a natural gas distribution company's 4annual filing under this section or at the time of the filing," which is the same language used in the prior HB 1188
