This bill would prohibit unauthorized switches of a customer's energy supplier. Presumably fills a legislative gap as slamming may only be prohibited by the UBPs but not statute. The bill would authorize the PSC to penalize ESCOs $1,000 per slammed meter.
Although the bill delegates to the PSC how to determine how customer authorization may be granted, the mere presence of this bill, if adopted, may prohibit municipal aggregation absent an enabling statute, as the current ability for the PSC to enact municipal aggregation is wholly premised on the issue of customer authorization being wholly within its domain (the PSC's continuing ability to authorize opt-out aggregation would depend on the bills' grant of discretion to the PSC in interpreting what "authorization" and "verification" means, and if the PSC could use its discretion to waive such requirements for aggregations).
