Here are the Competitive Market Conditions Placed on Exelon-Pepco Merger Under NJ Settlement

A settlement among Exelon, Pepco Holdings, Inc, (PHI), and New Jersey BPU Staff places several conditions on the acquisition of Pepco (and its Atlantic City Electric utility) by Exelon.

Most notably, a Special Purpose Entity created to execute the acquisition will maintain a separate name from and will not use the trademarks, service marks or other intellectual property of Exelon, PHI, or PHI's subsidiaries.

PHI and its utility subsidiaries will each maintain a separate name from and will not use the trademarks, service marks or other intellectual property of Exelon or its other affiliates, except that PHI and each of PHI's utility subsidiaries may identify itself as an affiliate of Exelon on a basis consistent with other Exelon utility subsidiaries.

PHI and its subsidiaries will hold themselves out as separate entities from Exelon and the SPE, conduct business in their own names (provided that PHI and each of PHI's utility subsidiaries may identify itself as an affiliate of Exelon on a basis consistent with other Exelon utility subsidiaries).
